Why There's No GST on Ready-to-Move Flats (and When You Still Pay It)

Why There's No GST on Ready-to-Move Flats (and When You Still Pay It)

If you've compared a ready-to-move flat with an under-construction one, you've probably noticed something. The under-construction flat comes with 5% GST on top of the price. The ready one doesn't. On an ₹80 lakh flat, that's ₹4 lakh. So why the difference, and is there a catch? There is one, and it trips up a lot of buyers. Here's how it works, in plain terms.

Quick summary

  • No GST on a ready flat. A flat that already has its Completion or Occupancy Certificate has no GST, as long as you pay for it after the certificate is issued.
  • Under-construction flats: 5% GST, or 1% for affordable homes, with no input tax credit.
  • Resale flats: no GST either.
  • The catch: if you pay anything before the OC, such as a booking amount, GST can apply to the whole price, not just that payment.
  • Still payable: stamp duty and registration, plus GST on some services such as brokerage and loan processing fees.

Why a ready-to-move flat has no GST

GST is a tax on supplies of goods and services. When a builder sells a flat that's still being built, the law treats the deal as a service: the builder is constructing a home for you. That service is taxed. Once the building is finished and has its Completion Certificate, or is first occupied if that happens earlier, selling a flat in it is simply a sale of property. GST law says the sale of land and of a completed building is neither a supply of goods nor a supply of services, so no GST applies. Property sales are taxed through stamp duty instead. In Pune, the certificate you'll usually see is the Occupancy Certificate (OC) from PMC, PCMC or PMRDA. Ask for it for your own wing, because big projects often get their OC one building at a time.

How to check the OC for your wing before you pay anything.

For GST, an affordable home is one with a carpet area of up to 90 sq m in a city like Pune (60 sq m in the six big metros) and a price of up to ₹45 lakh. These rates have applied since April 2019. The GST 2.0 changes from 22 September 2025 cut the tax on cement and other building materials, but left the rates on flats unchanged.

No GST on resale either. See what else to check.

How much GST a ready flat saves you

GST on under-construction flats in Pune at 5%: ₹3 lakh on ₹60 lakh, ₹4 lakh on ₹80 lakh, ₹5 lakh on ₹1 crore, ₹7.5 lakh on ₹1.5 crore, and no GST on ready-to-move flats
Flat priceGST if under construction (5%)GST if ready, with OC
₹60 lakh₹3,00,000₹0
₹80 lakh₹4,00,000₹0
₹1 crore₹5,00,000₹0
₹1.5 crore₹7,50,000₹0

Our calculation: 5% of the agreement value for a flat that doesn't qualify as affordable. For an affordable flat at ₹45 lakh, the 1% rate works out to ₹45,000.

The catch: money paid before the OC

GST on an ₹80 lakh flat: pay any part before the OC and 5% GST can apply to the whole price, ₹4 lakh; pay everything after the OC and there's no GST

The no-GST rule depends on when you pay, not when you move in. A flat is outside GST only if the entire price is paid after the Completion Certificate or OC is issued. If any part of it, even a booking amount, is paid before that, the sale counts as a construction service, and the way the law is generally read, GST then applies to the full price. Say you book a flat in a nearly finished tower for ₹80 lakh and pay a 10% booking amount of ₹8 lakh. The OC arrives a month later, and you pay the rest. Because part of the price was paid before the OC, 5% GST can apply to the whole ₹80 lakh, which is ₹4 lakh. If you wait for the OC and pay everything after it, there's no GST at all. So before you pay anything, ask the builder for a copy of the OC for your wing. "OC applied for" or "almost ready" doesn't count.

GST you may still pay on a ready flat

No GST on the flat doesn't mean no GST at all. A few related costs still carry it:

  • Brokerage: 18% GST on the broker's fee, if the broker is registered for GST.
  • Home loan charges: 18% GST on the processing fee and other bank charges.
  • Society maintenance: 18% GST if your share is more than ₹7,500 a month and the society's yearly turnover is more than ₹20 lakh. The tax department's view is that GST then applies to the whole amount, not just the part above ₹7,500.
  • Extras billed separately: club membership, parking or furnishing sold as a separate service may carry GST. Ask whether they're part of the flat's price.

Stamp duty and registration apply whether or not there's GST: about 7% in PMC and PCMC (6% if the flat is only in a woman's name), plus ₹30,000 registration.

Is a ready flat really cheaper because of GST?

Not always on the price tag. Builders pay GST on cement, steel and other materials, and under the 5% scheme they can't claim it back, so that cost is already built into the price of every flat, ready or not. Ready flats also tend to cost a little more per square foot because they're finished and there aren't many of them. What you avoid is the 5% on top. So compare the total cost: the price, GST, stamp duty, and the rent and pre-EMI you'd pay while waiting for an under-construction flat to be finished. In our waiting-penalty example, a "cheaper" under-construction flat ended up costing almost ₹12 lakh more.

Checklist before you pay

  • Ask for the OC (or Completion Certificate) for your wing, and check its date against your payment dates.
  • Check that the agreement and every receipt show no GST.
  • If the OC is only days away, ask whether you can pay the booking amount after it's issued.
  • Ask what's included in the price: parking, club membership, maintenance deposit.
  • Keep a record of every payment.

Frequently asked questions

Why is there no GST on ready-to-move flats?

GST applies to the construction of a flat that's sold before it's finished, because the law treats that as a service. Once a building has its Completion or Occupancy Certificate, selling a flat in it is a sale of property, which is outside GST. It's taxed through stamp duty instead.

Is GST applicable on resale flats?

No. A resale flat is a sale of an existing property, so there's no GST. You still pay stamp duty and registration.

What is the GST on under-construction flats in 2026?

5% of the price for most flats, and 1% for affordable homes, with no input tax credit. These rates didn't change in the GST 2.0 round in September 2025.

Is GST charged after the Occupancy Certificate?

Not if you pay the entire price after the OC. If you paid any part before the OC, such as a booking amount, GST can apply to the whole price, including what you pay after it.

Do I pay GST on the booking amount?

If you pay it before the OC is issued, yes, and it can bring GST onto the whole price. On an ₹80 lakh flat at 5%, that's ₹4 lakh, not just ₹40,000 on an ₹8 lakh booking. Pay nothing until the OC is issued and there's no GST.

What counts as affordable housing for GST in Pune?

A flat with a carpet area of up to 90 sq m and a price of up to ₹45 lakh. These attract 1% GST while under construction.

Did GST 2.0 change GST on flats?

No. The September 2025 changes cut GST on cement and other building materials, which lowers building costs, but the 5% and 1% rates on under-construction flats stayed the same.

Can I claim input tax credit on GST paid for a flat?

No. Home buyers can't claim it, and builders on the 5% or 1% scheme can't either.

Is there GST on society maintenance charges?

Yes, at 18%, but only if your share is more than ₹7,500 a month and the society's yearly turnover is more than ₹20 lakh. The tax department's view is that GST then applies to your whole monthly amount.
