Share your requirementWhy buy a resale flat
- Move in or rent it out as soon as the sale is registered, with no construction risk.
- See the real flat, the neighbours, the maintenance and the water supply before you pay.
- No GST, which under-construction flats attract.
- Older societies in established areas often have larger layouts.
- Prices are agreed with an individual seller, so there is usually room to negotiate.
How to buy a resale flat in Pune, step by step
- 1
Shortlist and visit
See the flat and the society in person, ideally at different times of day. Talk to residents about water supply, maintenance and parking.
- 2
Check the title and the building
Ask for the full chain of previous agreements, the Index II, the Occupancy Certificate and the share certificate. Have a lawyer run a title search, usually covering the last 30 years, before you pay a token.
- 3
Agree the price and sign an agreement for sale
Pay a token against a written agreement that sets the price, payment schedule, possession date and who pays which charges, including society transfer charges.
- 4
Get your home loan approved
The bank values the flat and checks its papers. The age of the building can affect the loan amount and tenure, so apply early.
- 5
Get the society NOC
The seller applies to the society for a no-objection certificate confirming there are no dues. If the seller has a home loan, their bank must issue a closure letter and return the original documents.
- 6
Pay, deduct TDS and register
If the price (or the stamp duty value) is ₹50 lakh or more, deduct 1% TDS from the payment and deposit it with Form 26QB. Pay stamp duty and register the sale deed at the sub-registrar's office.
- 7
Transfer the society membership and utilities
Apply to the society to transfer the share certificate into your name, then update the property tax and electricity records.
Documents to check
- Chain of previous agreements back to the original builder agreement
- Index II for each registration
- Occupancy Certificate (or completion certificate) for the building
- Society share certificate and NOC from the society
- Latest maintenance, property tax and electricity bills, paid up to date
- Seller's bank loan closure letter, if the flat was mortgaged
- Title search report from your lawyer
- PAN cards of buyer and seller (needed for TDS)

Resale flat questions
Is there GST on a resale flat?+
No. GST is not charged on a flat sold after its Occupancy Certificate (or completion certificate) has been issued, and that includes resale flats. Under-construction flats attract GST of 5%, or 1% for affordable housing, on top of the price.
Is stamp duty different for a resale flat?+
No. In PMC and PCMC it is the same as for a new flat: 7% of the higher of the agreement value and the ready reckoner value (6% for a woman buying in her sole name), plus registration of 1%, up to ₹30,000.
Do I need to deduct TDS when buying a resale flat?+
Yes, if the price or the stamp duty value is ₹50 lakh or more. You deduct 1% from the amount you pay the seller, deposit it using Form 26QB within 30 days from the end of the month of payment, and give the seller Form 16B. It is part of the price, not an extra cost, and you do not need a TAN.
How much can a housing society charge to transfer a flat?+
Under a 2001 Maharashtra government order, a co-operative housing society in a municipal corporation area such as PMC or PCMC can charge a transfer premium of at most ₹25,000. Who pays it is agreed between buyer and seller, so put it in the agreement for sale.
Can I get a home loan for a resale flat?+
Yes. Banks lend on resale flats on the same basis as new ones, after valuing the flat and checking its title. Older buildings may get a shorter tenure or a lower valuation, so check with your lender before you sign.
