Resale Flat vs New Flat in Pune: Which Should You Buy?

If you want to move in soon, you have two kinds of options: a flat in a building that's just been completed, straight from the builder, or a resale flat that someone has already lived in. Both let you skip the wait and the construction risk of an under-construction project. But they're very different purchases. A resale flat often gets you a better location and more space for the money. A new flat gives you a modern building, a fresh start and fewer paperwork headaches. This guide compares the two honestly, covers the costs people forget, and gives you a checklist for each.

Quick summary

  • Resale flats often offer a better location, a more established neighbourhood and less loading, so more usable space per rupee.
  • New ready-to-move flats come with modern amenities, builder warranty under RERA and simpler paperwork.
  • Costs are similar: no GST on either, the same stamp duty, but resale adds a society transfer fee (capped at ₹25,000) and often brokerage.
  • For a resale flat worth ₹50 lakh or more, you must deduct 1% TDS from the payment to the seller.
  • Banks lend on both, but for older buildings they look at the building's age and remaining life.

When a resale flat makes more sense

  • You want a specific, established location like Aundh, Kothrud, Viman Nagar or older parts of Baner, where new projects are rare or very expensive.
  • You want more space for your budget. Older buildings often have bigger rooms and lower loading.
  • You can see the neighbourhood as it really is, including traffic, water supply and how the society is run.
  • You're comfortable doing some repairs or renovation after you buy.

When a new ready-to-move flat makes more sense

  • You want modern amenities and security and don't want to spend on renovation.
  • You want simpler paperwork, with one seller (the builder) and documents already checked by the project's lenders.
  • You want the RERA defect warranty. The builder must fix structural defects and poor workmanship reported within five years of possession.
  • You're buying in a newer IT corridor like Hinjewadi, Kharadi or Wakad, where most good stock is relatively new anyway.

The costs people forget

Extra costs of a resale flat versus a new ready-to-move flat in Pune

Resale flat

  • Society transfer fee: Maharashtra caps the transfer premium a housing society can charge at ₹25,000. Societies can't add "donations" or other funds on top, and courts have backed buyers on this.
  • Brokerage: typically 1% to 2% of the price in Pune, charged to each side.
  • Renovation: for a flat over 10 years old, budget for plumbing, wiring, waterproofing and painting.
  • Pending dues: ask the society for a no-dues certificate so you don't inherit unpaid maintenance or bills.

New flat

  • Maintenance deposit: often 1 to 2 years of maintenance paid upfront.
  • Society formation and legal charges set by the builder.
  • Interiors: a new flat comes with no wardrobes or kitchen fittings beyond the basics, unless the builder offers them.

Home loans for resale flats

Banks are happy to lend on resale flats, with a few extra checks. They'll value the flat themselves and lend on the lower of that valuation and the agreed price. For older buildings, they also look at the building's age and remaining life. A 25-year-old building may get a shorter loan tenure or a lower loan amount. If the seller still has a home loan, your bank will usually pay off their loan directly, collect the original title documents, and then pay the balance to the seller. It's routine, but it takes a little more coordination than buying new.

1% TDS on resale flats worth ₹50 lakh or more

If you buy a flat from a resident seller and either the price or its stamp duty value is ₹50 lakh or more, you must deduct 1% TDS on the higher of the two and deposit it with the tax department, then give the seller a TDS certificate. Under the Income-tax Act, 2025 this is Section 393(1) (the old Section 194-IA), and from 1 April 2026 it's reported in Form 141, which replaced Form 26QB. On a ₹90 lakh flat, that's ₹90,000, which you pay to the government instead of the seller. If the seller doesn't have a PAN, the rate is 20%. If the seller is an NRI, different, higher TDS rules apply on the whole price. From 1 October 2026, resident individual buyers can deposit that TDS using their PAN instead of a separate TAN.

Resale flat document checklist

  • The full chain of sale agreements back to the original builder sale, ideally 30 years where available.
  • The building's Occupancy Certificate.
  • Share certificate and the society's NOC for the sale.
  • No-dues certificate from the society for maintenance and other charges.
  • Latest property tax and electricity bills in the seller's name, fully paid.
  • Encumbrance certificate or search report showing no other loans or claims.
  • If the seller has a home loan: the bank's statement of outstanding and list of documents it holds.
  • If the seller inherited the flat: the will, probate or succession certificate, and NOCs from other legal heirs.

How to Check an Occupancy Certificate

So, which one should you buy?

There's no single right answer. If location and space matter most and you're happy to manage some paperwork and repairs, a well-kept resale flat can be excellent value. If you want a modern building, amenities and the builder's warranty, a new ready-to-move flat is the simpler choice. Whichever you choose, check the Occupancy Certificate, compare prices on carpet area, and add up every cost before you decide.

Frequently asked questions

Is it better to buy a resale flat or a new flat?

It depends on your priorities. Resale flats often offer better locations and more space for the money. New ready-to-move flats offer modern amenities, a five-year builder warranty under RERA and simpler paperwork.

Is GST charged on a resale flat?

No. GST doesn't apply to resale flats or to new flats that already have their Occupancy Certificate.

Is stamp duty the same for resale and new flats?

Yes. In Pune it's about 7% (6% if the flat is only in a woman's name), plus a ₹30,000 registration fee, charged on the higher of the agreed price and the ready reckoner value.

How much can a society charge as transfer fee in Maharashtra?

The transfer premium is capped at ₹25,000. A society can also charge a small fee for changing the share certificate, but it can't demand donations or contributions to other funds as a condition of transfer.

Do I need to deduct TDS when buying a resale flat?

Yes, if the seller is a resident and the price or the stamp duty value is ₹50 lakh or more. You deduct 1% of whichever is higher and deposit it with the tax department. If the seller is an NRI, higher TDS applies on the whole price.

Can I get a home loan for a resale flat?

Yes. Banks lend on resale flats after valuing them. For older buildings, they look at the building's age and remaining life, which can reduce the loan amount or tenure.

What documents should I check before buying a resale flat?

The full chain of sale agreements, the Occupancy Certificate, share certificate, society NOC and no-dues certificate, paid property tax and electricity bills, and an encumbrance certificate. If the seller has a loan, get the bank's outstanding statement too.

How old a building is too old to buy in?

There's no fixed rule, but many banks get cautious with buildings over 25 to 30 years old, and maintenance costs tend to rise. Check the building's structural audit and whether the society is planning redevelopment.

Do resale flats come with a warranty?

The RERA five-year defect warranty runs from the date the builder first handed over possession. For an older resale flat, it has usually expired, so get the flat inspected before you buy.
